I need to swap lawyers as my lawyer is not on the Paratus AMC panel of conveyancing solicitors. How easy is it to change conveyancer?
If you haven't yet instructed a solicitor to do anything for you and have just received quotes, you're perfectly free to choose a different solicitor to carry out your work for you. The best way is to get recommendations from friends or family who have actually used the solicitor or conveyancer you're considering.
My conveyancer has informed me that he requires proof of ID documents asserting that this is part of his obligations as a solicitor on the Paratus AMC Solicitor panel. This is news to me - can I refuse?
Anti-terror and anti-money-laundering rules require solicitors and licensed conveyancers to verify the identity of the person or body they are dealing with before they can accept their conveyancing business. The Client Care letter that you need to sign will no doubt confirm this. Your lawyer is right that Paratus AMC also require certain documents to be viewed. If a you refuse to provide ID verification documents, your conveyancer would not be able to accept instructions from you. The law firm practices themselves provide us confirmation that they are on the Paratus AMC conveyancing panel as opposed to being supplied with a list from Paratus AMC directly.
The firm that I appointed last week on my purchase in Hendon has without warning shut down. They were on acting for me because I had to have a solicitor on the Paratus AMC conveyancing panel and my family lawyer was not. I gave them a cheque for £150 in advance. What do I do now?
Assuming that you have an Estate Agent in the equation then inform them straight away so that they advise the vendors that there may be a slight delay due to reasons beyond your control. Hopefully they will be sympathetic and urge their lawyer to send a new set of papers to your new solicitors. You will need to appoint new lawyers that are on the Paratus AMC conveyancing panel and notify the lender. If you have paid over any money it will hopefully be held by the SRA as money in an intervened firm's bank accounts is transferred to the SRA. Then, the SRA or the intervention agent looks at the intervened firm's accounts to work out who the money belongs to. To claim your money you will need to contact the SRA. If the SRA cannot return money you are owed from the firm's bank accounts, or if they can only return part of the money, you can apply to the Compensation Fund for a grant. Is the case that all CQS (Conveyancing Quality Scheme) solicitors on the Paratus AMC conveyancing panel?
It is true that some lenders now use CQS as the starting point for Panel membership such as HSBC and Santander. The Law Society’s CQS membership however gives no guarantee to lender panel acceptance. That being said,the CML have indicated that it is likely to become a pre-requisite for firms wishing to remain on their approved list of conveyancing solicitors.
I had instructed online conveyancers located in Birmingham who are on the Paratus AMC solicitor panel. They are now charging me a separate fee of £135 for dealing with the Paratus AMC mortgage. Is this an additional conveyancing fee specified by Paratus AMC?
Unfortunately, as long as it is in their Terms and Conditions or Quote then yes your solicitors can charge a fee for this. This fee is not set by Paratus AMC but by your lawyers. Some firms on the Paratus AMC will charge an ‘acting for lender’ fee but plenty of firms include it on their overall fee.
Paratus AMC have agreed my mortgage in principle, my offer on house has been accepted, now what?
The estate agent will want to know who your solicitors are (make sure these solicitors are on the lenders panel). Call up Paratus AMC or your broker and complete any relevant paperwork. Paratus AMC will tell you what documents they want. Paratus AMC will instruct a valuer. The valuer will get in touch with the estate agent or seller to book an appointment. Once conducted (assuming no problems) it takes about week to get a mortgage offer. Paratus AMC will issue the offer to you and your lawyer. The transaction will then take it’s course according the nature and complexity of the conveyancing.
