For what reasons would a firm of solicitors be excluded from the Landbay Partners approved conveyancing panel?
A survey recently commissioned by the Solicitors Regulatory Authority found that three quarters of solicitor practices had been excluded from a lender panel. The top reasons in order are :
- Low volume of transactions
- the lawyer is a sole practitioner
- as part of the HSBC panel reduction
- regulatory contact by SRA
- accidental removal. We are not aware of the specific or common criteria for removal by Landbay Partners
Please help. My conveyancer is advising me that he is legally obliged to apply for a Local Authority search as the firm are on the Landbay Partners conveyancing panel. Is this really necessary?
You have limited options available to you. As you are taking a mortgage with Landbay Partners your lawyer has to comply with their conditions as set out in their version of the CML Conveyancing Handbook. Your lawyer would have previously signed the Terms and Conditions of Landbay Partners’s conveyancing panel appointment which obliges them to follow the CML Handbook requirements last updated Landbay Partners. even if you were a cash buyer you would be ill advised not to carry out a local authority search.
Do lenders provide you with an approved list of solicitors? How do you know who is on the Landbay Partners conveyancing panel?
The law firm practices themselves provide us confirmation that they are on the Landbay Partners conveyancing panel as opposed to being supplied with a list from Landbay Partners directly.
My aunt passed away last year and as sole heir and executor was left the house. The house had a small mortgage left on it of around £8000. I want to transfer the title deeds into my name whilst I re-mortgage to Landbay Partners , pay off the mortgage etc. Is this possible?
If you intend to re-mortgage then Landbay Partners will insist on your using a conveyancer on the Landbay Partners conveyancing panel. This will help you to understand the registration process behind changing the details re the registered title. in your case it would appear that you are effectively purchasing the property from the estate. Your Landbay Partners conveyancing panel solicitor pays the new mortgage money into the estate, the estate pays off the old mortgage, the charge is released and you become the owner and the Landbay Partners mortgage is registered as a charge at the Land Registry.
I had instructed online conveyancers based in Cardiff who are on the Landbay Partners solicitor panel. They are now charging me a separate fee of £175 for the legal aspects of the Landbay Partners mortgage. Is this a supplemental conveyancing fee set by Landbay Partners?
Unfortunately, as long as it is in their Terms and Conditions or Quote then yes your solicitors can charge a fee for this. This fee is not set by Landbay Partners but by your lawyers. Some firms on the Landbay Partners will charge an ‘acting for lender’ fee and others do not.
I was told two weeks ago that my mortgage has been agreed
to by Landbay Partners. Is it usual for Landbay Partners to only issue the offer once my
solicitor is approved on their conveyancing panel?
A lender would not issue a mortgage until they have details of a lawyer on their panel. It can take a few weeks for Landbay Partners to deal with your lawyers application to be on the Landbay Partners conveyancing panel. There's no guarantee that your solicitors will be accepted.
